These Terms and Conditions (“Terms”, “Agreement”) govern your access to and use of our website, as well as the commercial transport, fleet management, and supply chain logistics services provided by Saktopaya Logistics Pvt Ltd.

By accessing this website or executing a freight/consignment note with us, you agree to comply with and be bound by these Terms. If you disagree with any part of these terms, you must not use our website or services.

1. Definition of Terms

  • “Company”, “We”, “Us”, or “Our” refers to Saktopaya Logistics Pvt Ltd.
  • “Customer”, “Shipper”, “Consignor” refers to the enterprise, individual, or entity booking logistics capacity or using this website.
  • “Goods” or “Cargo” refers to the materials, products, items, or bulk commodities entrusted to the Company for transport.

2. Website Use and Intellectual Property

  • All content, layout designs, high-capacity fleet graphics, images, logos, and data featured on this website are the exclusive intellectual property of Saktopaya Logistics, unless stated otherwise.
  • You may not replicate, distribute, or deep-link any material from this website for commercial use without explicit, written consent from our corporate management team.

3. Customer Declarations and Cargo Warranties

The Customer expressly warrants and covenants the following upon booking any transport asset:

  • Accurate Documentation: The Customer must provide completely accurate and lawful transit documentation, including but not limited to Commercial Invoices, Packing Lists, valid GST details, and mandatory HSN-compliant E-Way Bills prior to fleet dispatch.
  • Cargo Integrity: The Customer guarantees that the goods tendered for transport are legally owned or authorized for transport, securely packed to withstand standard highway transit conditions, and safely declared under the principle of “Said to Contain”.
  • Prohibited Items: Unless governed by a specialized hazardous-material contract, we do not accept explosive goods, contraband, illegal substances, unregistered industrial waste, or highly precious cargo like loose bullion/currency notes.

4. Freight Charges, Billing, and Detention

  • Quotations: All spot or contract freight rates quoted are based on the weight, volume, and cargo details provided by the customer at the time of booking. The Company reserves the right to re-weigh or re-measure cargo and adjust billing if variances are discovered.
  • Payment Terms: Invoices must be cleared by the due date stipulated on the commercial invoice. Delayed payments may attract an interest fee of up to 18% per annum, calculated daily from the due date until paid in full.
  • Lien on Freight: The Company reserves a general contractual lien on any cargo in our possession for all outstanding past or present dues owed by the Customer.

  • Vehicle Detention: Free loading and unloading hours will be defined in the specific vehicle arrangement contract. Detention charges apply if vehicles are delayed at customer facilities beyond the agreed window.

5. Limitation of Liability and Transit Timelines

  • Transit Projections: While Saktopaya Logistics deploys smart route optimization and tracking to ensure prompt deliveries, transport schedules are estimates and are not rigid legal guarantees. The Company is not liable for indirect or consequential financial losses arising from environmental or highway traffic delays.
  • Exclusions of Liability: We are not liable for internal cargo damages if the outer industrial packaging remains completely intact at delivery. We are also not liable for natural transit degradation, leakage, or evaporation typical to bulk material movement.
  • Force Majeure: The Company is entirely absolved of liability for transit failure or cargo delays caused by events beyond our reasonable control, including acts of God, extreme floods, labor strikes, civil unrest, political bandhs, or national highway closures.

6. Indemnification

The Customer agrees to indemnify, defend, and hold harmless Saktopaya Logistics Pvt Ltd, its directors, and operational staff against all claims, fines, regulatory penalties, or legal costs arising from the Customer’s failure to provide accurate documentation or complying with statutory customs and tax authorities.

7. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by, interpreted, and enforced in accordance with the laws of India. Any legal disputes, discrepancies, or actions arising from our website or freight services shall be subject exclusively to the jurisdiction of the competent courts where our primary corporate operational center is located.

8. Modifications to Terms

Saktopaya Logistics reserves the right to revise or amend these Terms and Conditions at any time to reflect changing operational frameworks or maritime/surface transport laws. Continued use of our website or services post-update implies acceptance of the revised Terms.
